Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the BuyForMe mobile application and related services (the "Service") operated by BuyForMe ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility & account
You must be at least 18 years old and able to form a binding contract under the laws of your jurisdiction. By creating an account, you represent that the information you provide is accurate and that you will keep it up to date.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@getbuyforme.app if you suspect unauthorised access.
2. The Service
BuyForMe is a peer-to-peer marketplace that connects two types of users:
- Buyers — users who request goods from another country.
- Travellers — users who agree to purchase and physically deliver those goods while travelling.
BuyForMe is not a party to any transaction between a Buyer and a Traveller. We provide the platform, messaging, identity verification, escrow payment processing, and dispute support — but the actual sale, purchase, and physical delivery of goods is a contract between the Buyer and the Traveller.
3. Bids, acceptance & matches
Buyers post requests describing the item, target price, and pick-up/delivery details. Travellers may submit bids. A binding match (a "Match") is formed when the Buyer accepts a specific Traveller's bid through the in-app flow.
Once a Match is formed, both parties commit to: (a) the Traveller purchasing and carrying the agreed item; (b) the Buyer accepting delivery and paying the agreed amount; and (c) communicating any changes through in-app chat so a record exists.
4. Payment, escrow & payouts
Payments are processed by Stripe, our third-party payment provider. By using the Service you also agree to Stripe's Consumer Terms and, for Travellers, the Stripe Connected Account Agreement.
When a Buyer accepts a bid, the agreed amount is charged and held in escrow by Stripe. Funds are released to the Traveller's connected Stripe account in one of two ways:
- Buyer confirmation — the Buyer taps "Complete" in-app after receiving the item, releasing funds immediately.
- Automatic release — if the Buyer does not confirm and has not opened a dispute within seven (7) days after the scheduled meet-up time, funds are released to the Traveller automatically. This protects Travellers from indefinite hold caused by Buyer inaction.
If a dispute is opened through in-app chat or via support@getbuyforme.app during the 7-day window, automatic release is paused until the dispute is resolved. Buyers who object to a delivery should raise the issue before the window expires.
BuyForMe charges a platform service fee of 15% of the tip (the Traveller's reward). The item price is reimbursed in full to the Traveller — no fee is charged on the item cost itself. Stripe's payment processing fee (approximately 1.75% + AU\$0.30) is borne by BuyForMe and is not passed through to the Traveller. These deductions are shown to both parties before a bid is accepted.
Founding Traveller program: the first one hundred (100) verified Travellers to complete a delivery on BuyForMe receive a lifetime 0% platform fee. To retain Founding status, those Travellers must complete at least three (3) deliveries within sixty (60) days of qualifying; otherwise Founding status reverts to the standard rate. The 100-spot cap is final and Founding status cannot be transferred between accounts.
We reserve the right to change fees with reasonable advance notice through the app or by email. Material fee changes (including the future standard rate) will be announced at least 14 days in advance, and existing Founding Travellers will retain their lifetime 0% status across such changes.
5. Refunds & disputes
If a Buyer believes the delivered item materially differs from the agreed description, is damaged, or was not delivered, the Buyer should first raise the issue with the Traveller through in-app chat before tapping "Complete", since tapping "Complete" releases the escrowed funds and significantly limits our ability to intervene.
If the issue is not resolved through chat, the Buyer may contact us at support@getbuyforme.app. We will review the in-app messaging, photos, and any other evidence both parties submit, and assist the parties in reaching a good-faith resolution. Possible outcomes include a full refund to the Buyer, a partial refund, or release of funds to the Traveller.
Our role is to mediate; we do not guarantee refunds or any particular outcome. Our determination is not legal arbitration, and users retain any rights they may have under the Australian Consumer Law or other applicable laws.
Cancellation after purchase. Before the Traveller purchases the item, the Buyer may cancel a Match at any time at no charge. Once the Traveller has purchased the item, the Buyer can no longer cancel unilaterally. Instead, the Buyer may submit a cancellation request through the app proposing a refund allocation — full (100%), partial (50%), or none (0%) — which the Traveller may approve or decline. If the Traveller approves, the agreed refund is processed through Stripe and any remaining amount is released to the Traveller to cover costs already incurred. If the parties cannot agree, either party may open a dispute under this section for BuyForMe to mediate. Where a transaction is cancelled and no delivery occurs, BuyForMe does not charge a platform service fee on the tip. Nothing in this clause limits any non-excludable rights you may have under the Australian Consumer Law.
6. User obligations
You agree to:
- Provide truthful information in requests, bids, and profile;
- Communicate respectfully through in-app messaging;
- Comply with all applicable customs, import, and tax laws of departure and destination countries;
- Carry only items you have a lawful right to purchase, transport, and deliver.
7. Prohibited items & conduct
You must not request, bid on, or carry items that are illegal to import or export, restricted under customs regulations, or fall into the following categories: weapons, ammunition, illegal drugs, prescription medications without a valid prescription, live animals, hazardous materials, counterfeit goods, currency or cryptocurrency, human remains or biological material, or any item violating intellectual property rights.
You must not use the Service to harass other users, send spam, attempt to circumvent payment outside the platform, or interfere with the Service's operation.
8. Verification & trust
To build trust, we may require identity verification (e.g. selfie + government ID matching) and travel verification (e.g. flight ticket upload). We use these signals to compute a "Flight Tier" displayed on profiles. Verification data is stored securely and used only for trust and safety purposes — see the Privacy Policy for details.
9. Third-party services
The Service relies on third-party providers including Firebase (Google) for authentication and push notifications, Supabase for data storage, Stripe for payments, Anthropic for image and document analysis, Google Maps for location and map display, and Cloudflare for this website and email forwarding. Your use of the Service is subject to each provider's terms as referenced in the Privacy Policy.
10. Intellectual property
The Service, including its software, design, brand, and content provided by us, is owned by BuyForMe and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
Content you upload (photos, descriptions, messages) remains yours, but you grant us a worldwide, royalty-free licence to host, display, and use it as necessary to operate the Service.
11. Disclaimers & liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, BuyForMe disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
To the extent permitted by law, BuyForMe is not liable for indirect, incidental, consequential, or special damages arising from your use of the Service.
12. Termination
You may close your account at any time through Settings → Account → Delete Account. We may suspend or terminate your account if you breach these Terms, engage in fraudulent or unlawful conduct, or for safety reasons.
Termination does not affect rights or obligations accrued before termination, including pending payments, disputes, or your obligations under sections 7, 10, and 11.
13. Governing law & disputes
These Terms are governed by the laws of the State of Victoria, Australia. You and BuyForMe each submit to the exclusive jurisdiction of the courts of Victoria.
Before commencing any formal proceeding, you agree to first contact us at support@getbuyforme.app and attempt to resolve the matter in good faith.
14. Changes & contact
We may update these Terms from time to time. Material changes will be notified through the app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
